H.R. 1723: Family Leave Insurance Act of 2009

Sponsor: Stark (D - CA)

Official Title: A bill to provide for a paid family and medical leave insurance program, and for other purposes.

Status:
3/25/2009: Introduced
3/25/2009: Referred to House Education and Labor Committee
3/25/2009: Referred to House Oversight and Government Reform Committee
3/25/2009: Referred to House Ways and Means Committee

Commentary:
This bill would create a federal and state Family and Medical Insurance Program under which employees would be entitled to family and medical leave benefit for a total of 12 work weeks during any 12-month period for a variety of reasons, including childbirth, adoption, and care-giving. Submitting false statements in support of an application for leave benefits would be a strict-liability criminal offense, not requiring any evidence that the person making the submission even knew that it was incorrect or “false.” Also prohibited would be “knowingly” presenting material statements in support of a claim for leave (though this is seemingly swallowed by the strict-liability offense) and bribing a claimant to apply for leave benefits. Violations would be punishable by criminal fines and imprisonment of up to 5 years.
