H.R. 3011: Transportation Security Administration Authorization Act of 2011

Commentary:
This bill would expand the current 18 U.S.C. § 709 to include the use of certain symbols, words, and acronyms relating to the Federal Air Marshals and the Transportation Security Administration (TSA). This is part of a larger authorization bill for the TSA. It would be a crime for a person or a corporation to, without written permission, use the words, acronyms, or symbols of those agencies on apparel or in a publication “in a matter that is reasonably calculated to convey the impression that the wearer of the item of apparel is acting pursuant to the legal authority of” the agencies or “to convey the impression” that the written materials “is approved, endorsed, or authorized by” the agencies. A violation of 18 U.S.C. § 709 by a business entity is punishable by up to a maximum fine under Title 18, U.S. Code. A violation by an officer or member participating or “knowingly acquiescing” in a business entity violation, or a violation by an individual, is punishable by imprisonment for up to one year and a maximum fine under Title 18.
